Fam360
Terms of Service
Acceptance of terms
Fam360 is published by Sarad Chhetri, based in Nepal. In these terms, "we" and "us" mean that publisher, "the app" means the Fam360 app for iPhone and iPad, "the service" means the app together with this website and the servers behind them, and "you" means the person using it.
By creating an account, joining a family, or otherwise using the service, you agree to these terms. If you do not agree to them, do not use the service.
Fam360 is distributed through the Apple App Store, so Apple's own terms apply to you as well. Where Apple's terms and these terms cover the same ground, Apple's terms govern your relationship with Apple and these terms govern your relationship with us.
An account may be held in your own name if you are 13 years of age or older. A family may well include younger children, and the app is built for that, but where a member is under 13, an adult parent or guardian sets up and manages that child's presence in the family, and it is the adult who agrees to these terms on the account's behalf. The app is not directed at children under 13.
Description of the service
Fam360 lets a small group of people who have chosen to share with each other see one another on a map, save places that matter to them, be told when someone arrives at or leaves one of those places, keep a shared calendar, and raise an alarm quickly.
It is a consumer convenience and coordination tool. It is not a security system, not a monitoring or surveillance product, and not a substitute for the emergency services. What it can show you is only ever as good as the position a phone last managed to report. A device that is switched off, out of signal, out of battery, or has had location permission withdrawn will not appear where its owner actually is.
We may change, add or remove features. Where a change materially reduces what the service does, we will say so in the app rather than rely on you re-reading this page.
Family spaces and accounts
Everything in Fam360 happens inside a family: a named space you either create or join. Membership is by invitation: whoever creates a family gets an invite code, and someone joins by entering that code or opening an invite link. Invite codes are reusable within the seven days after they are created, and expire after that.
Each member of a family holds one of three roles (owner, admin or member), and the role determines what they may change about the family. You are responsible for who you hand an invite code to. A code passed on to someone you did not intend to invite gives that person the same view of the family as anyone else in it, for as long as they remain a member.
You are responsible for keeping your account credentials to yourself and for everything done through your account. If you sign in with Google or Apple, keeping that account secure is on you and on them.
You may leave a family at any time, and an owner or admin may remove a member. Either way the membership record is deleted and that person's position stops being readable by that family.
Location and safety features
Sharing your location is a choice you make and can unmake. Your position is shared with the families you have joined, and Share my location in Settings pauses that at any time without leaving your family. Pausing deletes your stored position; an SOS you send still carries your location, because sending one asks your family to find you. You can also withdraw location permission entirely in iOS Settings; the app then tells your family that location is off for you rather than leaving a stale pin they might mistake for a current one.
Fam360 asks for background location, because a family map that only updates while someone is staring at their phone is not much use in the moment it matters. iOS will remind you of that permission periodically.
The app keeps a single current position per person per family. A new reading replaces the previous one. There is no location history for anyone to scroll back through.
Share the location of another person only with their knowledge and agreement. Fam360 is for families and households who have chosen to share with each other. Setting up or keeping an account on someone's device in order to track them without their knowledge is a misuse of the service and grounds for us ending your access. Where a child is too young to give that agreement, the parent or guardian who set the account up is responsible for the decision.
Location accuracy comes from the device and its operating system, not from us. Pins can be late, coarse, or wrong, and place alerts can fire late or not at all. Do not rely on any of it where being wrong would be dangerous.
Your responsibilities
- Give accurate account details, and keep them current.
- Use the service only for lawful purposes, and only in ways these terms allow.
- Do not use it to stalk, harass, intimidate or covertly monitor anyone, and do not share another person's location or details outside the family without their agreement.
- Do not raise a false SOS alert. It is the one part of the app that assumes the people receiving it will drop everything.
- Do not attempt to reach data belonging to a family you are not a member of, probe or interfere with our servers, or use an automated client, a modified build, or a reverse-engineered copy of the app.
- Do not resell, sublicense or commercially redistribute the service, and do not present it as your own.
- You are responsible for the content you put into a family (event titles, place names, profile photos, status messages, SOS messages), and for having the right to put it there.
- Carrier data charges, and the battery cost of background location, are yours.
Emergency and SOS features
Fam360 does not contact the emergency services. An SOS alert goes to the members of your families and to nobody else. It is not a 911, 112 or 999 call, it is not monitored by anyone at Fam360, and no one is on duty to respond to it. In an emergency, call your local emergency number first.
An SOS sends your position, your battery level, the time and any message you typed to your family, and pushes a notification to their devices. Whether that notification arrives, and how quickly, depends on their phones, their notification settings, their network, and on Apple's push infrastructure, none of which we control. Delivery is not guaranteed.
An SOS runs a short countdown before it sends, so a mistaken tap can be cancelled. Leaving the SOS screen cancels a countdown that is running. If you mean to send an alert, stay on the screen until it goes.
Crash detection is a backup, not a guarantee. When you turn it on, the app asks whether you are OK after what looks like a crash while you drive, and sends an SOS if you do not answer in time. It can miss a crash, ask when nothing happened, or not run at all, for example when the app has been force-quit, location access is not set to Always, or the phone is in Low Power Mode. Like any SOS, it does not contact the emergency services.
Subscriptions and payments
Parts of Fam360 require a paid subscription. A subscription is bought per family, not per person: one subscription covers everyone in that family.
Purchases are made through your Apple App Store account and are governed by Apple's terms. Price, billing period and what each plan includes are shown in the app at the point of purchase, and those are the terms that apply to your purchase.
| What | How it works |
|---|---|
| Billing | Fam360 offers Monthly and Annual subscription plans, charged to your App Store account. Prices are shown in U.S. dollars at checkout; your local App Store storefront may show a converted local-currency price, which Apple sets and handles. Subscriptions renew automatically unless you cancel. |
| Cancelling | Settings → your name → Subscriptions, on your iPhone or iPad. Cancelling stops the next renewal; the subscription runs to the end of the period you have paid for. |
| Deleting your account | Does not cancel an App Store subscription. Cancel it separately. |
| Refunds | Handled entirely by Apple under Apple's refund policy. We do not process refunds directly and cannot override Apple's decisions. |
| Free trial | New subscriptions include a 7-day free trial. Unless you cancel before the trial ends, it automatically converts to a paid subscription and your App Store account is charged. |
| Price changes | If we change subscription pricing, we will give you at least 30 days' notice before the new price applies to you. Continuing your subscription after that point means you accept the new price; if you don't, you can cancel before it takes effect. |
Subscription state is recorded from the store receipt and written only by our server, never by an app on a phone. If a purchase has gone through and the app has not caught up, force-quit and reopen it; if it is still wrong, get in touch with the date of the purchase.
We never receive your card details. Payment is between you and Apple.
Privacy
What the service collects, who processes it, how long it is kept, and how to switch sharing off or delete your account are set out in the Privacy Policy, which forms part of these terms.
The short version: your location is visible to the members of families you have joined and to nobody else. It is not sold, not shared with advertisers, and not used to build a profile of you. The app carries no advertising SDK and no crash-reporting SDK. It records which screens get opened, against an account id and never your name, email or position.
Intellectual property
The app, this website, the Fam360 name and logo, and everything we have written or drawn for them remain ours. Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple devices you own or control, for your own non-commercial use. Nothing else is granted.
The content you and your family put into the service stays yours. You grant us only the permission we need to run the service: to store your content, and to show it to the members of the families you have shared it with. We do not use it for anything else.
The three typefaces on this website are used under the SIL Open Font Licence 1.1 and are named in the colophon in the footer of this website.
Disclaimers
The service is provided as is and as available. To the fullest extent the law allows, we make no warranties of any kind about it, express or implied, and we specifically do not warrant that:
- it will be uninterrupted, timely, or free of errors;
- a location shown will be accurate, current, or where the person actually is;
- a place alert or reminder will fire, or fire on time;
- crash detection will detect a crash, or will not raise a false one;
- an SOS alert or any other notification will be delivered, or delivered promptly;
- it will keep working if a third party we depend on (Apple, Google, Expo, RevenueCat or our host) changes or withdraws their service.
Nothing here is advice about your safety. Fam360 is one input among many, and it is not the one to trust when someone's wellbeing is on the line.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you. Where you deal with us as a consumer, your statutory rights are unaffected.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive loss, or for lost profits, lost data, or loss of goodwill, arising out of your use of the service, including any harm that follows from a position being wrong or late, an alert not arriving, or the service being unavailable.
Our total liability to you for any claim arising out of or relating to these terms or the service, whether in contract, tort, or otherwise, will not exceed the total subscription fees you paid us in the 12 months before the event giving rise to the claim.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you deal with us as a consumer, you keep every right the law of your country gives you, and nothing here takes those away.
Termination
You can stop at any time: leave a family, pause sharing, or delete your account outright. Deleting your account is a button in the app, not an email you have to send and then chase. It removes your account, your profile, and your membership of every family you have joined.
We may suspend or end your access if you break these terms, in particular by using the service to monitor someone without their agreement, by raising false SOS alerts, or by attempting to reach data that is not yours. Where it is reasonable to do so, we will tell you why first and give you a chance to put it right.
Ending your access does not cancel an App Store subscription; cancel that separately. The sections on intellectual property, disclaimers, limitation of liability and governing law survive termination.
Changes to these terms
If these terms change, the date at the top of this page changes with them. If a change materially affects your rights or what you are agreeing to, we will say so in the app rather than rely on you re-reading this page.
Continuing to use the service after a change takes effect means you accept the updated terms. If you do not accept them, stop using the service and delete your account.
Governing law
These terms are governed by the law of Nepal. Any dispute arising out of or relating to these terms or your use of the service may be brought before any court of competent jurisdiction.
If you deal with us as a consumer, this does not deprive you of the protection of the mandatory laws of the country you live in, or of your right to bring a claim in your local courts where the law gives you that right.
